1. Agreement to Terms

By accessing this website or using any services provided by OzNourish, you agree to be bound by these Terms of Service. If you do not agree to these Terms, please do not use our website or services.

These Terms constitute a legally binding agreement between you ("Client", "you", or "your") and OzNourish, operated by Bilqees Fatema, qualified nutritionist ("we", "us", or "our").

2. About OzNourish

OzNourish is an Australian-based nutrition services business operated by Bilqees Fatema, a qualified nutritionist based in Western Sydney, NSW, Australia. We provide evidence-based nutrition support to individuals seeking to improve their health, wellbeing, and relationship with food.

3. Services Provided

OzNourish offers the following services:

  • Individual nutrition consultations (in-person, phone, or video via Zoom)
  • Personalised meal planning
  • Dietary assessments and nutrition advice
  • Nutrition education and resources
  • Weight management programs
  • Health and wellness programs
  • Group workshops and programs (where available)
  • Digital nutrition resources (e-books, guides)

4. Scope of Practice

What OzNourish Provides:

  • Evidence-based nutrition assessments and personalised recommendations
  • Customised meal plans and dietary guidance
  • Nutrition education, counselling, and lifestyle advice
  • Review and interpretation of nutrition-related information

What OzNourish Does Not Provide:

  • Medical diagnosis, treatment, or prescriptions
  • Management of complex eating disorders requiring psychiatric or medical treatment
  • Emergency or crisis medical services
  • Guarantees of specific health or weight outcomes
  • Services outside the scope of qualified nutrition practice

For clients with complex medical conditions, we encourage collaborative care with your GP or medical team. We may recommend medical clearance before beginning services in certain circumstances.

5. Client Eligibility and Responsibilities

Eligibility:

  • Clients must be 18 years or older to enter this agreement independently
  • Services for clients under 18 require written parental or guardian consent
  • By booking, you confirm you are seeking services in good faith

Client Responsibilities — You agree to:

  • Provide accurate, complete, and up-to-date health and personal information
  • Disclose all relevant medications, supplements, health conditions, and dietary restrictions
  • Notify us promptly of any changes to your health status
  • Follow professional advice to the best of your ability and communicate any difficulties
  • Attend appointments on time or provide the required cancellation notice
  • Pay for services in accordance with current fees
  • Treat Bilqees Fatema with respect and courtesy at all times
  • Consult your GP or appropriate medical professional for concerns outside nutrition practice

6. Appointments and Scheduling

  • All appointments are confirmed upon receipt of payment or booking confirmation
  • Initial consultations are typically 60–90 minutes
  • Follow-up consultations are typically 30–45 minutes
  • Late arrivals will not extend session time; full fees apply
  • Arriving more than 15 minutes late may result in rescheduling at our discretion

Cancellation Policy:

  • 48+ hours notice: Full refund
  • Less than 48 hours: 50% fee charged
  • No-show: 100% fee forfeited

OzNourish reserves the right to cancel or reschedule appointments due to illness, emergency, or unforeseen circumstances. You will be offered an alternative appointment or a full refund.

7. Fees and Payment

Fees are listed on our website and may be updated periodically. The fee applicable at the time of booking will apply to your appointment.

Payment Terms:

  • Payment is required at the time of booking or prior to service delivery
  • We accept bank transfer and PayID
  • Package fees must be paid in full prior to accessing sessions

Health Fund Rebates:

  • Some private health insurers may offer rebates for nutrition consultations
  • You are responsible for checking your eligibility and claiming from your insurer
  • OzNourish will provide a receipt or invoice for claiming purposes
  • We are not responsible for insurer decisions regarding rebate eligibility

Medicare rebates are not currently available for nutrition services provided by a nutritionist. Please check with your private health insurer for cover options.

Non-Payment:

  • Continued non-payment may result in suspension of services
  • Outstanding fees may be referred to a collections process
  • You remain liable for all fees incurred

8. Telehealth Services

Video and phone consultations are available via Zoom.

Client Requirements:

  • Stable internet connection (for video)
  • Private, quiet environment
  • Working camera and microphone (for video consultations)
  • You are responsible for any technical issues on your end

Telehealth may not be suitable for all clients or circumstances. We reserve the right to recommend in-person consultation where appropriate. Telehealth cannot be used for emergency situations.

9. Confidentiality

Bilqees Fatema maintains strict confidentiality over all client information in accordance with Australian Privacy Principles and professional standards. Your information will not be disclosed without your consent except where required by law or where a serious risk of harm exists. Please refer to our Privacy Policy for full details.

10. Intellectual Property

All content created by OzNourish, including meal plans, recipes, educational handouts, website content, guides, and branding, is the intellectual property of Bilqees Fatema and OzNourish.

Permitted Use:

  • You may use materials provided for your personal use only
  • You may share materials with household members involved in meal preparation

Prohibited Use:

  • Reproducing, distributing, selling, or sharing our materials publicly
  • Using our materials for any commercial purpose
  • Sharing on social media, websites, or platforms without written permission
  • Removing copyright or attribution notices

11. Testimonials and Reviews

By providing a testimonial or review, you grant OzNourish permission to use it in marketing materials, confirm it is truthful and based on your genuine experience, and understand it may be edited for length or clarity without changing meaning. You may request removal at any time by contacting us. We will never use identifiable health information in marketing without your specific written consent.

12. Limitation of Liability

To the maximum extent permitted under Australian law:

  • OzNourish does not guarantee specific health, weight, or wellness outcomes
  • Results vary between individuals based on many factors including adherence, lifestyle, and health status
  • OzNourish and Bilqees Fatema are not liable for any indirect, consequential, or incidental damages arising from the use of our services or reliance on our advice
  • We are not liable for outcomes resulting from inaccurate information provided by the client
  • Nothing in these Terms limits your rights under the Australian Consumer Law

13. Client Conduct

You agree to communicate respectfully and professionally with Bilqees Fatema at all times. OzNourish reserves the right to terminate services immediately, without refund, in cases of harassment, abuse, threatening behaviour, discrimination of any kind, dishonest or misleading conduct, or any behaviour that is inappropriate or disruptive.

14. Termination of Services

By You: You may cease services at any time, subject to our Refund and Cancellation Policy.

By OzNourish: We reserve the right to terminate services if you breach these Terms, engage in inappropriate conduct, fees remain unpaid, continuing services would be professionally inappropriate, or your needs fall outside our scope of practice. Where possible, we will provide referrals to appropriate alternative practitioners upon termination.

15. Referrals

OzNourish may refer you to other healthcare professionals including GPs, specialists, or allied health practitioners where your needs fall outside our scope. Referrals are made in your best interest and do not constitute endorsement of any specific practitioner or service.

16. Dispute Resolution

In the first instance, please contact Bilqees Fatema directly to resolve any concerns. We will acknowledge your concern within 2 business days and aim to resolve it within 10 business days.

If the matter is not resolved, you may submit a formal written complaint requesting escalation. If resolution cannot be reached, you may seek mediation or pursue remedies through the relevant consumer protection body in your state or territory.

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the jurisdiction of NSW courts.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be severed and the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms of Service, together with our Privacy Policy, Refund and Cancellation Policy, and Disclaimer, constitute the entire agreement between you and OzNourish with respect to the use of our services.

19. Amendments

OzNourish reserves the right to update these Terms at any time. Updated Terms will be posted on this website with a revised Last Updated date. Continued use of our services after changes are posted constitutes your acceptance. Active clients will be notified of significant changes via email with at least 14 days notice.

20. Acknowledgment

By booking a service or using the OzNourish website, you confirm that:

  • You have read and understood these Terms of Service
  • You agree to be bound by these Terms
  • You consent to our collection and use of your information as described in our Privacy Policy
  • You have had the opportunity to ask questions before proceeding
